Gifting Gold or Diamonds Internationally: Ownership Documents to Prepare

A gift of gold bars or polished diamonds can be a genuine transfer of ownership, but the fact that no sale price is paid does not remove the need for accurate records. Border authorities, carriers and recipients may need consistent information about the items and the parties.

Record the parties clearly

Use each person’s correct legal name and relevant contact information in confidential documentation. Distinguish the donor/owner from the shipper and the recipient/consignee. These roles may overlap, but should not be guessed.

Describe precisely what is being gifted

The transfer instrument and itemized manifest should match. For gold bullion, list bar counts, actual weights and identifying marks. For polished diamonds, include stone count, carat weights and available identification reports.

What might a deed of gift contain?

  • Identification of donor and donee
  • Clear intent to gift the listed property without a sale
  • Detailed schedule of the goods
  • Effective date and relevant transfer conditions
  • Signatures and, where applicable, witnessing or authentication formalities

A document is only meaningful if it reflects a genuine lawful transaction. Obtain appropriate legal review for the jurisdictions involved.

Keep the valuation independent of the transfer label

Goods can retain substantial customs or other assessed value when gifted. Support values with authentic invoices, credible appraisals or another defensible methodology. Never describe property as valueless solely because it was given away.

Check customs and recipient obligations

Depending on route, there may be export and entry declarations, identity checks, fiscal implications, sanctions restrictions and carrier procedures. The European Commission provides general customs declaration guidance; destination authorities should be consulted for their own rules.

Confirm delivery to the right person

Before dispatch, clarify who is authorized to receive the goods, what identification will be required, and what delivery receipt or proof of handover will be available.

Key point

A gift deed helps explain ownership transfer. It is not an export licence, customs release, insurance certificate or proof that a carrier has accepted the shipment.
